Is it legal to launch an attack on a friends's metabolism?

NOTICE OF POTENTIAL GLYCAEMIC ENDANGERMENT
(A work of educational fiction)

From: Bhaskar Rao, Advocate
To: Anil Deshmukh

Dear Mr. Deshmukh,

I acknowledge with thanks the receipt of a box of sweets recently delivered to my residence. What appeared, at first sight, to be a gesture of goodwill has, upon scientific examination, raised serious concerns regarding my health, safety, and continued enjoyment of old age.

The consignment was found to contain approximately 200 grams of sweets. A preliminary nutritional assessment indicated that the contents possess the capability of generating approximately 920 calories, due to the associated quantities of sugar, other carbohydrates and fats.

Being a cautious citizen and a 62-year-old individual, I considered it necessary to investigate the physiological consequences of consuming the said material.

Accordingly, on the morning of 9 November, I conducted the following experiment:

1.    Fasting blood glucose level recorded prior to consumption: 92 mg/dL.

2.    Quantity of sweet consumed: 50 grams.

3.    Blood glucose level subsequently recorded: 143 mg/dL.

The increase observed between the two measurements was, in my considered opinion, both statistically significant and emotionally disturbing.

Had I proceeded to consume the remaining 150 grams, I reasonably apprehend that my blood glucose levels might have risen much further. Such an outcome could have exposed me to risks including, but not limited to:

Additional medical consultations;
Unscheduled lectures from my physician;
Increased expenditure on laboratory tests;
Temporary suspension of culinary pleasures; and
Domestic supervision regarding dietary habits.

I am therefore constrained to place on record that the delivery of the aforesaid sweets may constitute an act capable of exposing the recipient to elevated glucose levels, diminished dietary discipline, and an increased likelihood of unsolicited health advice.
In State of Maharashtra v. Anonymous Pedha Supplier (2021) 9 D.L.J. (Dessert Law Journal) 93, the Court recognized that a recipient is entitled to damages where repeated offerings of confectionery result in measurable expansion of the waistline.

I trust that in future, before dispatching edible substances of this nature, you will provide adequate warning notices, nutritional disclosures, and, where appropriate, accompanying sugar-free alternatives.

Notwithstanding the foregoing, I confirm that the sample consumed was of excellent taste and quality. Any further scientific investigations into the remaining contents shall be undertaken solely in the interests of public health and shall not be interpreted as evidence of enjoyment.

This communication may be treated as a friendly caution. However, should additional consignments of similar sweetness arrive without prior notice, I reserve the right to take such action as may be necessary, including but not limited to further consumption, repeated testing, and the submission of additional complaints.

Yours faithfully,

Bhaskar Rao

Advocate

Disclaimer: No actual legal claim is asserted herein. The complainant's principal grievance is that the sweets were extremely delicious and too tempting to be shared with others!
